Previously, Trump issued an executive order attempting to prevent automatic US citizenship for children born to parents who are undocumented or hold temporary visas. However, lower courts obstructed this action, referencing the 14th Amendment, which guarantees citizenship to individuals born or naturalized in the US who are subject to its jurisdiction.
In late June, the US Supreme Court also ruled against Trump’s initial attempt, a decision he criticized as “very unfortunate.”

The 14th Amendment does not apply to individuals not under US jurisdiction, such as the offspring of foreign diplomats. Additionally, US authorities can already refuse visas if they believe an applicant’s main purpose for visiting is to give birth.
Trump’s latest action is part of his extensive immigration enforcement campaign, which includes plans to deport millions of undocumented immigrants and remove deportation protections for people from over a dozen countries.
