ADC takes INEC to court over removal of David Mark and Aregbesola from Party records

The African Democratic Congress (ADC) has filed a lawsuit in the Federal High Court in Abuja, requesting an order to compel the Independent National Electoral Commission (INEC) to reinstate the names of David Mark and Rauf Aregbesola as the party’s National Chairman and National Secretary, respectively.

This legal action, designated as case number FHC/ABJ/CS/1819/2025, comes in response to the removal of their names and those of other members from the party’s National Working Committee on INEC’s official website on April 1.

In a motion dated April 7, Mark’s attorney, Sulaiman Usman (SAN), urged the court to issue a mandatory injunction requiring INEC to restore the affected officials to their previous positions prior to the dispute.

The application, lodged in accordance with the Federal High Court (Civil Procedure) Rules of 2019, seeks three primary reliefs, including an order to overturn INEC’s decision to remove the National Working Committee members from its portal.

Additionally, the ADC is requesting that the electoral commission be compelled to continue monitoring the party’s congresses and conventions until the case is resolved.

The party has also asked the court to order INEC to promptly restore and maintain the records recognizing David Mark as National Chairman and Rauf Aregbesola as National Secretary, along with other members of the National Executive Committee.

Furthermore, the ADC seeks an injunction preventing INEC from interfering in its leadership structure or acknowledging any competing claims until the matter is conclusively addressed.

This legal dispute represents a new development in the ongoing leadership crisis within the ADC, as the party strives to stabilize its internal framework in preparation for upcoming poli tical endeavors.
